In accordance with the provisions of Decree-Law No. 24/2014, of February 14, and Law No. 94/96, of July 31, this document establishes the terms and conditions to be observed in the use of the website www.rumotojawa.pt, as well as in the process of purchasing the products sold there, made available to its users.

Therefore, users of the website should carefully read the terms and conditions and privacy policy before using it, since by using it or placing an order, users are consenting to being bound by these conditions.

If you disagree with these terms and conditions and privacy policy, you should not use the website www.rumotojawa.pt.

These conditions may be changed, freely, and without any prior notice, in order to adapt them to applicable legislation. As such, it is the responsibility of users to periodically read the Privacy Policy and General Terms and Conditions, as the provisions in force on the date of use of the website and the conclusion of the contract (as defined herein) will apply.

These general terms and conditions of sale are agreed between Rumoto, with registered office at Viela dos Moinhos Nº8, 4760-195 Gavião, Vila Nova de Famalicão, with NIPC 207535671, and any user wishing to make a purchase through the website www.rumotojawa.pt.

1º Order

1º The user may place an order through the website www.rumotojawa.pt, filling in all the required fields and providing their personal data. By doing so, the user expresses their full and complete acceptance of the general terms and conditions of sale, the prices and the characteristics of the products included in the order. All orders are subject to acceptance by Rumoto.

2º Orders are subject to stock availability. The unavailability of the ordered products in stock, or any other reason for the impossibility of fulfilling the order, will be communicated by Rumoto to the user. In this case, Rumoto will reimburse the user for any amounts paid, as stipulated in article 19 of Decree-Law No. 24/2014, of February 14.

3º Rumoto reserves the right to remove any product from the website www.rumotojawa.pt at any time, as well as to delete or alter any material or content, and will not be liable for such action to the user or any third party, nor for the unavailability of the product, under the terms referred to in clause 2 of this article.

2º Order Execution

1º After confirmation of full payment for the products as well as shipping costs, and without prejudice to the provisions of clauses 2 and 3 of article 1, the order will be completed within 30 days.

3º Shipping Costs

1º Delivery of orders to the Rumoto store does not imply any shipping costs.

2º Delivery of orders to the user’s home, or to an address indicated by them for this purpose, will imply the obligation for the user to bear the delivery costs, depending on the value of the products ordered and depending on the area, under the following terms:

We only deliver orders to European Union.

4º Price and Payment

1º In accordance with current legislation, the prices established on the website www.rumotojawa.pt are in euros, including taxes and duties, on the date of issue of the corresponding invoice.

2º The applicable VAT rate will be the one in force in the Member State of the place of delivery, according to the orders placed.

3º Prices and specifications are subject to change without prior notice.

4º Rumoto declines any responsibility for any errors published on the website www.rumotojawa.pt.

5º In the event that the actual price of the ordered product is higher than that shown on the website, the The user will be contacted to accept or cancel the order.

6º If the actual price of the ordered product is lower than that shown on the website www.rumotojawa.pt, the user will be refunded the difference between the actual value and the value paid.

7º The user may use the following payment methods: Bank Transfer, Paypal, Multibanco and Mbway.

5º Transfer of Risks

The risks of the product will be the responsibility of the user from the moment of delivery.

6º Right of Withdrawal and Return

If you wish to return an item purchased from the website www.rumotojawa.pt, you must inform us beforehand by email (geral@rumotojawa.pt).

The item to be returned must be in perfect condition, with original packaging, labels, manuals and accessories. The original packaging must not show any signs of opening or use. The original packaging of the item to be returned is not suitable as shipping packaging; it must be properly packed to avoid damage to the item.

The Customer may return items that:

Have not been used and show no signs of assembly and/or alteration;

They have not been damaged and show no signs of installation;

Have the original packaging intact with all the components of the item, as well as all the original labels;

Have the invoice for the respective purchase (an indispensable document);

Shipping costs for ‘returns’ are the responsibility of the customer. Items returned with payment due upon delivery will not be accepted.

You have 14 consecutive days to complete this procedure.

Once we receive the returned item, it will be carefully checked by the Rumoto technical team. Returns accepted by Rumoto will be processed with a Credit Note within 5 business days of receiving the item at our facilities, via bank transfer.

In case of ‘returns’, shipping costs will not be reimbursed, except in the case of an error in the item sent by us. In cases of items with manufacturing defects (proven), they will be treated as ‘Warranties’ (see conditions below).

Important!Rumoto reserves the right not to accept returns of material resulting from orders executed with references indicated by the customer, as well as orders of specific material intended only for one customer. This also applies to electrical and electronic material.

The completion of the Order implies the customer’s ACCEPTANCE of the Return conditions described above.

7º Warranties

The warranty applies in accordance with current legislation (Decree-Law No. 67/03 of April 8), except for parts/components subject to wear and tear resulting from their use. The warranty terms also expire in cases of negligence, abuse, misuse, incorrect or improper use and installation of the item.

If the buyer detects any defect or damage, they must first contact Customer Service via email at geral@rumotojawa.pt, attaching the following documents:

Purchase invoice for the product (copy);

Form (provided after contacting customer service).

Subsequently, the product must be sent to Rumoto, properly packaged, for analysis.

Warranties are processed directly with the manufacturer/supplier, and they are the ones who ‘accept’ or ‘reject’ the warranty. This process may take a maximum of 30 days. Rumoto cannot expedite the exchange/replacement until the manufacturer authorizes it.

In the event of a manufacturing defect being verified, Rumoto undertakes to repair or replace the item. Items that present any issues will be sent to the manufacturer for quality screening, repair, or replacement.

If the manufacturer/supplier authorizes the replacement, Rumoto will be responsible for sending the item to the customer, at no cost to them, to the address indicated in the initial order.

In the case of a warranty ‘refusal’ due to no anomaly being found in the item, and it being in perfect condition, the customer will be informed of the situation beforehand. The item in question will be returned to the customer at the address indicated in the initial order, and these shipping costs will be borne by the customer, and will be determined on the date of reshipment of the item.

Transportation expenses to our facilities will not be reimbursed.

8º Warranty Exclusions

If you do not have the purchase invoice and original product packaging, labels, manuals and respective accessories (if applicable), in perfect condition;

Parts/Components subject to wear and tear from use, such as Pistons, Cylinder Kits, Crankshafts, Tires, Cables, Hoses, etc.;

Electrical parts/components such as Coils, Batteries, Control Units (CDIs), Voltage Regulators, Electronic Ignitions, Coil Plates, etc.;

Parts/Components intended for Competition. These products aim to improve and/or increase vehicle performance, are for use in track racing and not on the road, the customer assumes responsibility for checking the vehicle before and after the start. We decline any responsibility for accidents that may occur due to the assembly of this type of component;

Defects caused by incorrect handling: the warranty does not cover defects caused by the product being used in conjunction with/or linked to any other product, accessory, or by it being used for a purpose other than that for which it is intended;

Items not installed correctly by the customer or by non-specialized professionals. In this case, the invoice for the respective installation may be requested;

The warranty does not apply if the product has been opened, altered or repaired by any entity other than the manufacturer, or if it has been repaired using unauthorized subsequent parts, or if the product’s serial number is illegible;

Consequence of an accident: fall, water or fire; or damage resulting from adverse external influences, for example, voltage spikes, floods, thunderstorms, etc.;

Products sold by Rumoto are properly labeled. Products automatically lose their warranty if the label is removed and/or damaged;

Warranties do not include the payment of compensation or any other expenses required due to malfunction or improper application/assembly of products supplied by our company.

Before activating any warranty, please carefully review our Terms & Conditions and ensure that the product is indeed broken.

9º Refund of Payments

Refunds of payments made, in cases of exercising the right of withdrawal and for defective products, will be made using the same method used to make the payment.

10º Exchange

Products purchased on the website www.rumotojawa.pt cannot be exchanged.

11º Right of Withdrawal

The user has the right to withdraw from this contract within 14 calendar days, without having to give any reason.

The deadline for exercising the right of withdrawal expires 14 days from the day following the day on which the contract was concluded.

In order to exercise your right of withdrawal, you must notify us at Rumoto, Viela dos Moinhos Nº8, 4760-195 Gavião, Vila Nova de Famalicão, or by telephone +351 252 024 394 (Call to a national landline network) or by email to geral@rumotojawa.pt of your decision to withdraw from the contract by means of an unequivocal statement sent by registered letter by mail or email.

To ensure the withdrawal period is respected, it is sufficient that the communication regarding the exercise of the right of withdrawal is sent before the end of the withdrawal period.

12º Effects of Free Resolution

In case of termination of this contract, all payments made under it will be refunded to the user, including delivery costs (except for supplementary costs resulting from the choice of a delivery method other than the least expensive standard delivery method offered by us), without undue delay and, in any case, no later than 14 days from the date on which we are informed of your decision to terminate this contract. Refunds will be made using the same means of payment used in the initial transaction, unless expressly agreed otherwise by the user; In any case, the user will not incur any costs as a consequence of such reimbursement.

The reimbursement may be withheld until we have received the returned goods, or until the user provides proof of shipment of the goods, whichever occurs first.

In situations where the contract involves the delivery of goods to users:

In case of termination of the contract, the user must return the goods to Rumoto without undue delay and no later than 14 days from the day on which the user informs us of the free termination of the contract. The deadline is considered met if the user returns the goods before the end of the 14-day period.

The costs of returning the goods will be borne by the user.

The user is only responsible for the depreciation of the goods resulting from handling that exceeds what is necessary to verify the nature, characteristics and functioning of the goods.

13º Responsibility

1º For all stages of access to the website www.rumotojawa.pt, as well as the ordering, delivery and after-sales service process, Rumoto only has an obligation of means.

2º Rumoto does not guarantee or assume responsibility for any inconvenience or damage inherent to the use of the internet network, service interruption, external intrusion or presence of computer viruses, or any other case of force majeure.

3º The products will be described and presented on the website www.rumotojawa.pt with the greatest possible accuracy. If, nevertheless, errors occur on the website www.rumotojawa.pt, Rumoto is not responsible for such fact.

4º The provisions of this article do not affect the rights granted to users regarding withdrawal from the contract.

14º Processing of Personal Data

1º The information or data provided by users will be processed in accordance with the provisions of the Privacy Policy.

2º By using the website www.rumotojawa.pt, the user consents to the processing of the information and data referred to in the preceding paragraph and declares that all the information provided is true and corresponds to reality.

3º Personal data will be used by Rumoto for information, dissemination and order processing.

4º The user is guaranteed the right to access, rectify, alter or delete their personal data, simply by sending an email to geral@rumotojawa.pt.

5º Notwithstanding Rumoto proceeding Regarding the secure collection and processing of data that prevents loss or manipulation, using the most advanced techniques for this purpose, we inform you that collection via an open network allows the circulation of personal data without security conditions, running the risk of being viewed and used by unauthorized third parties.

15º Virus, Piracy and Other Computer Attacks

Rumoto is not responsible for any damages or losses resulting from a denial-of-service attack, virus or any other technologically harmful or damaging program or material that may affect the user’s computer, computer equipment, electronics, data or materials, as a result of using the website www.rumotojawa.pt, or downloading content from it or the content to which it redirects.

16º Intellectual Property

1º All elements, sound or visual, of the website www.rumotojawa.pt, including the underlying technology, are protected by copyright, trademarks or patents.

2º Users who have a personal website and wish to place a simple direct link to the page www.rumotojawa.pt on their website for personal use must request prior authorization from Rumoto. Authorization is only valid if provided in writing.

3º Any link or hypertext directed to the website www.rumotojawa.pt, using framing or in-line linking techniques, is formally prohibited.

4º In all cases, the use of any link, including those referred to in points 2 and 3 of this article, even if authorized, must be removed upon simple request from the company Rumoto.

17º Total Agreement

These general terms and conditions of sale constitute the entire agreement between Rumoto and you. If any clause of these conditions becomes null or void due to legislative or regulatory changes or a court ruling, it will be considered unwritten.

18º Unilateral Amendment to these Terms and Conditions

1º These terms and conditions may be amended at any time. The user is subject to the policies and conditions in force at the time they are using the website www.rumotojawa.pt or placing their order, except when, by law or decision of governmental bodies, changes are made retroactively.

2º In the case provided for in the second part of the preceding paragraph, the changes will also affect orders that the user has placed under the conditions subject to amendment.

19º Applicable Law and Jurisdiction

These terms and conditions are governed by Portuguese law. Any dispute arising from these terms and conditions shall be submitted to the competent Portuguese court.

20º Alternative Dispute Resolution

In case of a consumer dispute, the consumer may resort to a Consumer Dispute Resolution Entity.
